Terms of use and disclaimers

This page, together with the documents referred to on it, tells you the terms on which you may make use of this site and any interactive services on it. Please read these Terms of Use carefully before you start to use the Site

By using the Site, you accept these Terms of Use and you agree to abide by them. If you do not agree to these Terms of Use, please cease using the Site immediately.

The information presented herein is for guidance purposes only.  Materials provided on this Site are provided “as is”, without warranty of any kind, either express or implied. The Norwegian Seafarers’ Union (“NSU”) specifically does not make any warranties or representations as to the accuracy or completeness of any such Materials.

The NSU periodically adds, changes, improves or updates the Materials on this Site without notice. Under no circumstances shall the NSU be liable for any loss, damage, liability or expense incurred or suffered that is claimed to have resulted from the use of this Site, including, without limitation, any fault, error, omission, interruption or delay with respect thereto.

The use of this Site is at the User’s sole risk. Under no circumstances, including but not limited to negligence, shall the NSU, its affiliates, employees, agents, contributors, independent contractors, or officers be liable for any direct, indirect, incidental, special or consequential damages.

This site may contain advice, opinions and statements of various information providers. The NSU does not represent or endorse the accuracy or reliability of any advice, opinion, statement or other information provided by any information provider. The reliance any such advice, opinion, statement, or other information shall also be at the User’s own risk. Neither the NSU nor its affiliates, nor any of their respective agents, employees, information providers or content providers, shall be liable to any User or anyone else for any inaccuracy, error, omission, interruption, deletion, defect, alteration of or use of any content herein, or for its timeliness or completeness, nor shall they be liable for any failure of performance, computer virus or communication line failure, regardless of cause, or for any damages resulting there from. The NSU accepts no responsibility or liability whatsoever with regard to the information on this site.

 

2. Interruption of Service

The NSU makes every effort to ensure that the quality of the Site remains high and to minimize disruption caused by technical errors. However, the internet is not an inherently stable medium and information sent via the Site will pass over public telecommunications networks.  The NSU does not warrant that the functions contained in the material contained in the Site will be secure, uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy and reliability of the materials.  As a result, the NSU does not accept any ongoing obligation, liability or responsibility in respect of the same. The NSU accepts no responsibility with regard to such problems incurred as a result of using this site or any linked external sites.

 

3. Links to Third Party Websites

This Site may contain links and references to third-party web sites. The linked sites are not under the control of the NSU, and the NSU is not responsible for the content of any linked site or any link contained in a linked site. The NSU provides these links only as a convenience, and the inclusion of a link or reference does not imply the endorsement of the linked site.

 

4. Intellectual Property Rights and Acceptable Uses

All intellectual property rights in the site and in the content published on it which is not in the public domain are owned by or licensed to the NSU or otherwise used as permitted by applicable law.  Those works are protected by copyright laws, other intellectual property rights, and treaties around the world. All such rights are reserved.

You may not change or modify any material on this Site without prior written authorization from the NSU whether in hard copy or electronic format.

You may not link frame or deep-link the material on this Site onto any other website without the express permission of the NSU.  No material on this Site may be used or distributed for commercial exploitation.

Material on this Site OWNED BY THE NSU may be used for personal and/or non-commercial purposes and in support of trade union activities.  This permission DOES NOT APPLY to material supplied by third parties. For permitted use of third party material, apply to the relevant owner.

 

5. Submission of Content

If you submit any material to the Site including without limitation any text, graphics, video or audio (Content), or make contact with other users of the Site, you warrant that all data provided by you is accurate and that the material does not infringe anyone’s rights under the relevant law. If Content does comply with these conditions, you agree to indemnify us for any breach of that warranty.  The NSU reserves the right to remove any Content if in its opinion and at its sole discretion such material is inappropriate or does not further our purposes.

Any Content you submit to the Site will be considered non-confidential save that if Content is submitted classified as such.

Any Content you submit to the Site will be considered non-proprietary unless otherwise clearly indicated, and by such submission, you grant NSU all intellectual property rights with respect to the Content save that if the NSU publishes the Content, it will acknowledge the author thereof.  If you do not wish to grant such rights to the NSU, it is suggested that you do not submit your Content to the Site.

 

6. Indemnity

As a condition of use of this Site, the User agrees to indemnify the NSU and its affiliates from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorneys’ fees) arising out of the User’s use of this Site, including, without limitation, any claims alleging facts that if true would constitute a breach by the User of these Terms and Conditions. If the User is dissatisfied with any Material on this Site or with any of its Terms and Conditions of Use, the User’s sole and exclusive remedy is to discontinue using the Site.

You agree on demand to indemnify, defend and hold harmless NSU from and against any claims, damages, losses, liabilities, and all costs and expenses of defense arising out of or in relation to: your breach of these Terms of Use; or any claim that is based on your use of the Site, your submission or dissemination of any of the information in the Site or content in the Site.  You will cooperate as fully and as reasonably required in NSU’s defense of any claim. The NSU reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you will not in any event settle any matter without the written consent of the NSU.

 

7. Law and Jurisdiction

These Terms of Use are governed by Norwegian Law. The Norwegian Courts will have exclusive jurisdiction over any claim or dispute arising out of or in connection with the use of the Site.   You are solely responsible for insuring compliance with your local laws while using the Site and the materials contained in the Site.

 

8. Variations

The NSU reserves the right to amend these Terms of Use at any time by posting changes online.  You agree to be bound by such amendments from the date on which they are posted on the Site. If you cannot accept such amendments, your only remedy is to cease using the Site.

 

9. Separability

If a court holds any of the Terms of Use to be illegal, invalid or unenforceable, the rest of the Terms of Use shall remain in full force.
